DMCA Policy
At FirstTryExam, we respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to notices of alleged copyright infringement that are properly submitted to our designated DMCA agent as outlined below.
How to submit a Notice of Claimed Infringement
If you believe that material available on our website infringes your copyright, you may notify our DMCA agent by providing the following information in writing:
- Identification of the copyrighted work or works claimed to have been infringed. Important: please include your copyright registration number when available. If the work is not yet registered, include a copy of the application you filed with the U.S. Copyright Office (see http://www.copyright.gov/eco/).
- Identification of the material on our servers that is claimed to be infringing and that you request us to remove, including the full URL(s) or other information sufficient to enable us to locate the material.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and under penalty of perjury, that you are the owner (or authorized to act on behalf of the owner) of the exclusive right that is allegedly infringed.
- Your physical or electronic signature, or the signature of someone authorized to act on your behalf.
- Contact information where you may be reached, including an email address, postal address, and telephone number (email is preferred).

Counter-Notification (How to respond if your content was removed)
If your content was removed or disabled because of a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a written counter-notification to our DMCA agent. A valid counter-notification must include the following:
- Identification of the removed content and its location before removal (for example, the URL).
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court in the judicial district in which your address is located (or, if you are outside the United States, that you consent to the jurisdiction of any U.S. federal district court in which FirstTryExam may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
- Your physical or electronic signature.
Send counter-notifications to our DMCA agent at dmca@firsttryexam.com (electronic submissions accepted). After we receive a counter-notification meeting the statutory requirements, we will forward the counter-notification to the party who submitted the original DMCA notice. Unless the claimant files a court action seeking a court order to restrain you from engaging in the allegedly infringing activity, we may restore the removed content within approximately 10–14 business days after receipt of the counter-notification.
Repeat Infringer Policy
FirstTryExam has adopted a policy of terminating, in appropriate circumstances and at FirstTryExam's sole discretion, the accounts of users who are repeat infringers. FirstTryExam may also restrict access to the Website and/or terminate accounts for any user who is determined to be a repeat infringer.
Reservation of Rights
FirstTryExam reserves the right to remove or disable access to any content at any time, in its sole discretion, whether or not such content is the subject of a DMCA notice. Nothing in this policy limits FirstTryExam's other legal rights or remedies, including the right to pursue civil or criminal action in appropriate cases.
Non-U.S. Claims
While the DMCA is U.S. law, we will review and consider bona fide claims of intellectual property infringement that originate outside the United States in good faith. Submit international notices to the DMCA agent above; we will respond in accordance with applicable law.
Important Notes
- FirstTryExam may share the details of your notice or counter-notice with the alleged infringer as necessary to resolve the claim.
- Filing a false DMCA notice or counter-notice may expose you to liability for damages (including costs and attorneys' fees) under applicable law.
